    Spain. IVF & Surrogacy Legal Reference

    Spain is one of Europe's most accessible IVF destinations for single parents and same-sex couples. Surrogacy contracts are null and void under Spanish law.

    Under Spanish law (Ley 14/2006 de Técnicas de Reproducción Humana Asistida), IVF is available to all women regardless of marital status or sexual orientation. Surrogacy contracts are null (Article 10).

    Governing Law

    • Ley 14/2006 de Técnicas de Reproducción Humana Asistida (TRHA). Primary statute regulating assisted reproduction.
    • Article 10 TRHA. Declares surrogacy contracts null and void; birth mother is legal mother.
    • Instrucción DGRN 5 October 2010. Allowed registration of foreign surrogacy births under specific conditions (later contested).

    IVF Access

    • Available to heterosexual couples, single women, and lesbian couples.
    • Egg and sperm donation permitted; donors are anonymous under Spanish law.
    • Double gamete donation allowed.
    • No upper age limit in private clinics, though public coverage has age restrictions.
    • Male same-sex couples cannot access IVF domestically without a gestational carrier: which is prohibited.

    Surrogacy Status

    Prohibited. Spanish law voids surrogacy contracts. The birth mother is the legal mother by default.

    Spanish intended parents frequently pursue surrogacy in the United States, Canada, or Mexico. Recognition upon return depends on the documentation and the child's best interests.

    Cross-Border Recognition

    Spanish authorities have registered children born via surrogacy abroad when the foreign birth certificate or court order meets certain requirements. However, recognition is not automatic and has been subject to legal challenges. The Tribunal Supremo has ruled inconsistently on this issue.

    Spanish citizens: including gay male couples, solo gay fathers, and same-sex couples, frequently pursue gestational surrogacy in the United States. Article 10 TRHA voids domestic surrogacy contracts but does not preclude access to surrogacy-friendly US jurisdictions. Recognition upon return is case-dependent and has been subject to judicial inconsistency at the Tribunal Supremo level.
