Surrogacy in the USA for Queer Families

The United States offers the most legally established pathway for LGBTQ+ intended parents to access gestational surrogacy. In states including California and Nevada, same-sex couples and single individuals have equal legal access to surrogacy, enforceable contracts, and pre-birth parentage orders.

For EU and UK intended parents, US surrogacy is logistically accessible but requires additional legal steps in the home jurisdiction. US parentage documents are not automatically recognized in all European countries.

    Legal Access by Origin

Structural overview only. Not legal advice. Consult a licensed reproductive attorney in both the US and your home jurisdiction.

    🇺🇸

    California

    Fully accessible

Pre-birth orders for solo and coupled LGBTQ+ parents. No marital or residency requirement for IPs.

    🇺🇸

    Nevada

    Fully accessible

Comprehensive surrogacy statute. Pre-birth orders available for all family structures.

    🇺🇸

    Connecticut / Maine / Washington

    Fully accessible

Statutes explicitly include same-sex couples and single individuals.

    🇬🇧

    UK intended parents

Accessible in US; UK recognition requires further steps

Commercial surrogacy abroad is lawful for UK citizens. UK parentage must be established post-birth in UK courts. US PBO alone does not confer UK parentage.

    🇪🇺

    EU intended parents

Accessible in US; EU recognition varies by member state

France, Germany, Italy prohibit domestic surrogacy but have recognized US-obtained parentage in some cases. Consult a reproductive attorney in both the US and home country.

    🌍

    Non-resident / visa requirements

    Logistics apply

Non-US residents must plan for multiple US trips: medical screening, transfer cycle, and birth. Newborn's US passport is separate from home-country citizenship proceedings.

    The Surrogacy Pathway

A deterministic 10-step sequence for LGBTQ+ intended parents pursuing US gestational surrogacy. Steps are sequential but timelines vary by clinical and legal progress.

    01

    Jurisdiction selection

Choose a US state with clear LGBTQ+ surrogacy law. California and Nevada are the most established.

    02

    Sperm banking or retrieval

One or both partners may contribute. Sperm is cryopreserved for use in IVF. Sperm quality assessment is completed first.

    03

    Egg donor selection

Male couples and solo gay dads require a donor egg source. Agencies, clinics, or known donors are all options.

    04

    IVF and embryo creation

The clinic fertilizes donor eggs with selected sperm. Embryos are biopsied and tested via PGT-A if indicated.

    05

    Carrier matching

A licensed agency matches intended parents with a screened gestational carrier. Independent legal counsel is mandatory for both parties.

    06

    Gestational Carrier Agreement

A licensed reproductive attorney drafts the contract. Both parties must have independent representation. No exceptions.

    07

    Embryo transfer and pregnancy

One embryo is transferred to the carrier. Medical monitoring continues through the carrier's OB practice.

    08

    Pre-Birth Order

Filed in the chosen state court. Establishes intended parents as legal parents before birth.

    09

    Birth and US documentation

Birth certificate lists intended parents. US passport for the child can be initiated immediately.

    10

    Home-country parentage (EU/UK)

EU and UK citizens must separately establish parentage in their home jurisdiction. Requirements vary by country. A specialist attorney in both territories is required.

    Cost Structure

Most US surrogacy journeys for LGBTQ+ intended parents using IVF, egg donation, and a gestational carrier cost between $150,000 and $200,000+, once agency fees, surrogate compensation, IVF treatment, legal work, insurance, and a contingency buffer are included.

    ItemEstimated range
    Agency fees$25,000 – $50,000
    Surrogate compensation$40,000 – $60,000
    IVF + egg retrieval$20,000 – $35,000
    Egg donor costs$15,000 – $30,000
    Legal fees (US attorneys)$8,000 – $15,000
    Insurance for surrogate$15,000 – $30,000
    Miscellaneous + contingency$10,000 – $20,000
    Total (estimated range)$150,000 – $200,000+

Figures are estimates based on current US market data. EU and UK intended parents should add international travel, translation, and home-country legal fees.

EU and UK Intended Parents: What Differs

US surrogacy is lawful to pursue abroad

EU and UK citizens are not prohibited from accessing surrogacy in the United States. The legal constraints are domestic: EU countries with surrogacy prohibitions regulate what happens within their borders, not what citizens do abroad.

Home-country parentage is a separate legal process

A US Pre-Birth Order or US birth certificate does not automatically confer legal parentage in EU or UK home countries. UK intended parents must file in UK courts. EU requirements vary by member state: France, Germany, Spain, and Italy have each taken differing approaches to recognizing foreign surrogacy parentage.

    The child's citizenship and passport

A child born in the US to EU or UK intended parents has US citizenship by default. Home-country citizenship must be separately applied for through consular proceedings. Timeline and documentation requirements vary.

    Germany

Germany prohibits domestic surrogacy and has historically been restrictive in recognizing foreign surrogacy parentage, though court rulings have varied. Independent legal advice in Germany is essential before proceeding.

    France

France's Court of Cassation has recognized children born via surrogacy abroad in certain conditions. However, domestic surrogacy is prohibited and the legal landscape is complex. French intended parents should obtain specialist legal counsel before initiating any arrangement.

    United Kingdom

UK surrogacy law permits altruistic surrogacy domestically. UK citizens accessing surrogacy in the US must complete a Parental Order in UK courts after birth. The Parental Order replaces the surrogate's initial legal status and establishes UK-recognized parentage.

    Key Structural Facts

    • ·Gestational surrogacy for LGBTQ+ intended parents is legal in California, Nevada, Connecticut, Maine, and Washington, among other states.

    • ·Single gay men and non-binary solo intended parents have legal access to surrogacy in all major surrogacy-friendly states.
    • ·Male same-sex couples and solo gay dads require both an egg donor and a gestational carrier. These are two separate legal and medical relationships.
    • ·A Pre-Birth Order establishes parentage before the child is born and is the gold standard in surrogacy-friendly US states.
    • ·EU and UK citizens can pursue US surrogacy but must account for additional home-country parentage proceedings.
    • ·Total costs for LGBTQ+ US surrogacy typically range from $150,000 to $200,000+ inclusive of all major components.
    • ·Sperm from one or both male partners can be used to create embryos. This is a medical decision made with the IVF clinic.
