A surrogacy lawyer prepares the legal agreements that govern the arrangement and represents either the intended parents or the surrogate. Each side must have separate legal representation to protect their rights.

Legal work begins before embryo transfer. The gestational carrier agreement must be fully executed before the clinic proceeds with the medical protocol. After pregnancy is confirmed, the lawyer files for a pre-birth or post-birth parentage order depending on state law.
What people usually misunderstand
The intended parents' lawyer and the surrogate's lawyer must be different people. Independent legal counsel for the surrogate is a standard requirement, not an optional step. This protects both parties and strengthens the enforceability of the agreement.
